We are the data controller for the personal data described in this policy. We are currently completing our registration with the Information Commissioner's Office and will publish our registration number here once issued.

What this policy covers
This policy explains how we handle personal data collected through our website and in the course of general business contact. If you are a candidate — someone we are considering for, or have introduced to, a role — our Candidate Privacy Notice applies to you in addition to this policy.
Information we collect
Information you give us: your name, email address, telephone number, company name, job title, and anything else you include in a form submission, email or booking request.
Information collected automatically: IP address, browser and device type, pages viewed, time spent on the site, and referring source. This is collected through cookies and similar technologies — see our Cookie Policy.
Information from third parties: publicly available business contact information from sources such as LinkedIn, company websites and business data providers, where we are considering whether our services may be relevant to your organisation.
How we use your information and our lawful basis

Who we share your information with
We share personal data with service providers who process it on our behalf under written contract. These currently include our email and productivity provider (Microsoft), our website platform (Squarespace), our outreach and data tooling, and our accountants. We may also disclose data where required by law or to establish or defend legal claims.
We do not sell personal data.
International transfers
Some of our service providers are based outside the UK, including in the United States. Where personal data is transferred outside the UK, we rely on the UK International Data Transfer Agreement, the UK Addendum to the EU Standard Contractual Clauses, or an applicable adequacy decision, and we carry out transfer risk assessments where required.
How long we keep your information
We keep enquiry and business contact data for two years from our last meaningful contact with you, unless a longer period is required for legal or accounting purposes. Data we are required to retain for tax purposes is kept for six years.
Security
We maintain technical and organisational measures appropriate to the risk, including access controls, multi-factor authentication, encryption in transit, and restricted access on a need-to-know basis.
Your rights
Under UK data protection law you have the right to: request access to your personal data; request correction of inaccurate data; request erasure; request restriction of processing; object to processing based on legitimate interests; request portability; and withdraw consent where consent is our basis.

We are the data controller for your personal data. We are currently completing our registration with the Information Commissioner's Office and will publish our registration number here once issued.
This notice explains what we do with your information when you register with us, apply for a role through us, or when we approach you about an opportunity. Please read it alongside our Privacy Policy.

Where we get your information
We collect information about you from the following sources:
Directly from you — when you register, submit a CV, complete a form, or speak with us
Publicly available professional sources — including LinkedIn, professional networking platforms, company websites, published directories, and business data providers
Referrals — where a mutual contact recommends you, or where you are named as a referee
Job boards and application platforms — where you have made your profile available to recruiters
Your referees and, where relevant to a specific role, background screening providers, with your knowledge
If we obtained your data from a source other than you directly, we will tell you within one month of collecting it, or at the point we first contact you if that is sooner.
What information we collect
Contact details; employment history and current role; current and target remuneration, including base salary, commission structure and quota attainment; notice period; qualifications and certifications; the contents of your CV; our interview and screening notes; your role preferences and motivations; references; and, at offer stage, evidence of your right to work.
Our lawful basis for using your data
Legitimate interests is our primary basis. Our legitimate interest is operating a recruitment business and matching candidates with suitable opportunities. We have carried out a Legitimate Interests Assessment and concluded that this processing does not override your rights and freedoms, in particular because we process only professional information, we contact you about opportunities relevant to your career, and you can object at any time.
Legal obligation applies to right-to-work checks and to our tax and accounting records.
Consent applies where we send you marketing communications that are not about a specific relevant opportunity, and to any special category data you choose to share with us. You may withdraw consent at any time.
Special category data
We do not require and do not routinely collect special category data. If you voluntarily disclose information — for example about a health condition or an adjustment you need during the recruitment process — we will use it only to support you through that process and only with your explicit consent, and we will share it with a client only where you ask us to.
How we use your information
We use your data to assess your suitability for roles, to discuss opportunities with you, to prepare and submit your profile to clients, to manage the interview and offer process, to maintain our candidate network so we can contact you about future opportunities, and to meet our legal obligations.
We will not send your CV or personal details to any client without telling you which client it is and obtaining your agreement first.
Automated processing
We use technology to help organise and search our candidate records, including tools that surface relevant profiles based on experience and skills. These tools support our consultants; they do not make decisions about you. Every decision to progress, shortlist or reject a candidate is made by a person. You will not be subject to a decision based solely on automated processing that produces legal or similarly significant effects.
Who we share your data with
Client organisations — only with your prior agreement, on a role-by-role basis
Referees you have nominated
Our service providers — including our email and productivity provider, applicant tracking and CRM systems, and communications tools, all under written contract
Professional advisers, or authorities where required by law
We do not sell your data.
International transfers
Some of our clients and service providers are based outside the UK, including in the United States. Where your data is transferred outside the UK we rely on the UK International Data Transfer Agreement, the UK Addendum to the EU Standard Contractual Clauses, or an adequacy decision, and we assess the risk of each transfer.
If a role you are being considered for is with an overseas employer, we will tell you before sharing your details.
How long we keep your data
We keep your data for two years from our last meaningful contact with you, after which it is deleted or anonymised. "Meaningful contact" means a conversation, an application, or your engagement with a relevant communication from us. We review our candidate records periodically.
Where we are required to retain records for legal or tax reasons, we keep those specific records for six years.
You can ask us to delete your data sooner at any time.
Your rights
You have the right to: access your data; have inaccurate data corrected; request erasure; request restriction of processing; object to our processing based on legitimate interests, including profiling; request portability of data you provided to us; and withdraw consent where consent is our basis.

4. Regulatory Status
MK9 Technologies Limited acts as an employment agency in relation to permanent and fixed-term vacancies, and as an employment business in relation to temporary and contract vacancies, as defined by the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003.
Our Terms of Business are provided to clients on engagement and are available on request.
